Myprotein & Thomas Cook Holiday Competition - Competition Rules (“Rules”)

These Rules set out how you can enter for a chance to win a holiday by participating in a prize draw available to all qualifying Myprotein customers (“Promotion”). The Promoter is The Hut.com Limited (trading as Myprotein) whose registered office is at 5th Floor, Voyager House, Chicago Avenue, Manchester Airport, M90 3DQ (“Myprotein” or “we”).

By entering the Promotion, you are deemed to have read and understood these Rules and shall be unconditionally bound by them. A copy of these Rules shall be available at https://www.myprotein.com for the duration of the Promotion. These Rules should also be read in conjunction with Myprotein’s terms and conditions, available at Myprotein x Thomas Cook | MYPROTEIN™

We reserve the right to amend these Rules without notice from time to time. Any amendment shall be notified to you by email.

How to enter

To be entered into this Promotion, you will need to:

(a) visit https://www.myprotein.com/; and

(b) place any product in your basket you wish to purchase on https://www.myprotein.com; and

(c) go to the checkout and add ‘Thomas Cook Holiday Giveaway’ voucher to your basket;

(d) finalise your order by signing in to your ‘Myprotein’ account or, if you do not have an account registered with ‘Myprotein’, sign-up for a ‘Myprotein’ account by providing a valid email address and a password, or checkout as a guest by providing your valid email address;

(e) place your order between 00:01 GMT on 31 December 2021 and 17:00 GMT on 31 January 2022; and

(f) following the receipt of an email from Myprotein with the subject line “Your offer is now ready to redeem”(the “Qualifying Email”), follow the links in the email directing to Myprotein’s Instagram account (https://www.instagram.com/myprotein; handle: @myprotein) (“Myprotein Instagram Account”) and Thomas Cook’s Instagram account (https://www.instagram.com/thomascook/?hl=en; handle: @thomascook) (“Thomas Cook Instagram Account”) and start ‘following’ both the Myprotein Instagram Account and Thomas Cook Instagram account. For the avoidance of doubt, if you already follow either or both of the Myprotein Instagram Account and/or the Thomas CookInstagram Account, you are still required to follow the links in the Qualifying Email directing to the Myprotein Instagram Account and/or the Thomas Cook Instagram Account,

points (a) – (f) above altogether shall be a “Qualifying Order”.

To multiply your chance of winning, an additional entry to the Promotion can be obtained by downloading the Thomas Cook UK mobile app. To do this:

(i) follow the links in the Qualifying Email directing you to download the Thomas Cook UK mobile app from the Google Play store or Apple App store; and

(ii) download the Thomas Cook UK mobile app;

altogether “Qualifying Download”.

This Qualifying Download will account for 1 additional entry into the competition, giving entrants a maximum of 2 entries to the competition. For the avoidance of doubt, if you have already downloaded the Thomas Cook UK mobile app, you can still multiple your chance of winning by following the link in the Qualifying Email directing to the Thomas UK mobile app in the relevant app store download page and that will constitute a Qualifying Download too.

There is no cost to sign-up for a Myprotein account. There is no cost to download and sign-up for a Thomas Cook UK Mobile app account. Your operator’s standard data or communication charges shall apply for access to the Myprotein website, the Myprotein Instagram Account, the Thomas Cook Instagram Account and the Thomas Cook mobile app. For the avoidance of doubt, you must still be following the Myprotein Instagram Account, the Thomas Cook Instagram Account and you must still have downloaded the Thomas Cook mobile app (if applicable) at the time of the Prize draw.

Opening and closing dates

The Promotion will begin at 00:01 GMT on 31 December 2021 (“Opening Date”) and will close at 23:59 GMT on 31 January 2022 (“Closing Date”). Any entries submitted after the Closing Date will not be counted. No responsibility will be taken by Myprotein for any entry that is misdirected, lost for technical or other reasons or received after the Closing Date.

Who can enter and entry restrictions

Entries are limited to two per person (one Qualifying Order and one Qualifying Download).

You must be at least aged 18 years of age (or the age of majority in the jurisdiction where you reside if higher) at the time of entry. The Promotion is only open to residents in the UK (excluding Northern Ireland). Myprotein reserves the right to request proof of age and residency before awarding any prize and to disqualify any entrant who is unable to provide such proof on request.

You are not permitted to enter the Promotion if you are an employee of MyProtein or any The Hut Group company, or the Prize Provider, their direct family member or agent, or if you are otherwise professionally connected with the Promotion.

In entering the Promotion, you confirm that you are eligible to do so and eligible to claim any prize you may win.

Prizes:

An eligible entrant may receive one of the following prizes:

1) Weekend in London: There will be one winner of a holiday in London for 2 persons worth up to £1000, including accommodation for two nights in a hotel of the choice of the winner selected from the following list London City Breaks & Holidays 2022 / 2023 | Thomas Cook, and one excursion selected by the winner from the following list https://www.thomascook.com/extras/experiences and https://experiences.thomascook.com/tEBFBN06 , for a weekend (from a Friday till Sunday) in between 01.05.2022 and 31.12.2022 (“Weekend in London”).

2) Week in Turkey: There will be one winner of a holiday for a week at Thomas Cook’s Club Alanya in Turkey for 2 persons including half board service, return flight from an airline of choice of the Prize Provider from a UK airport selected by the winner and transfer from the airport to the accommodation at arrival and from the accommodation to the airport at departure from 01.05.2022 until 31.12.2022 but with the exclusion of the following dates: 11.04.2022 – 17.04.22; 01.07.2022 – 31.07.2022; 01.08.2022 – 31.08.2022 (“Week in Turkey”).

3) Week in Dubai: There will be one winner of a holiday for a week in Wyndham Dubai Marina in Dubai for 2 persons inclusive of a return flight from an airline of choice of the Prize Provider from a UK airport selected by the winner and transfer from the airport to the accommodation at arrival and from the accommodation to the airport at departure in between 01.05.2022 and 31.10.2022 (“Week in Dubai”).

Point 1 – 3 above altogether shall be referred to as “Prize(s)”.

Any other travel expenses, costs incurred by the winners and their guests in addition to those set out above and that are incidental to the fulfilment of the Prizes are the responsibility of the winner and their guest (including, but not limited to any costs or implications relating to a coronavirus restriction and/or a positive coronavirus test).

Prizes are subject to valid passport and visa (if applicable) of the winner and their guest and coronavirus restrictions in the UK and the destination of the Prize. The winners’ and their guests are responsible for holding adequate travel insurance. Winners must be fit to travel and adhere to all local and airline restrictions and requirements. The Prizes are provided by Thomas Cook Tourism (UK) Company Limited (Company number 12211539) with registered address at The Broadgate Tower, Third Floor, 20 Primrose Street, London EC2A 2RS(“Prize Provider”).

The winners of each Prize will be selected at random by a draw performed by a computer process from all eligible entries within 7 days of the Closing Date. The winner will be notified by email within 3 weeks of the Closing Date (“Prize Notification”). The winner must respond by email to the Prize Notification to confirm that the winner accepts the Prize and must provide the details requested in the Prize Notification to the Promoter. Failure by the winners to respond to the Prize Notification and provide the details requested in the Prize Notification to the Promoter within 14 days of the Promoter sending the Prize Notification will be deemed to be a forfeiture of the Prize by the winner and the Promoter reserves the right to select another winner (again selected randomly in a draw) from all remaining eligible entries.

Any queries in relation to the Prizes must be directed to the Prize Provider.

Each Prize is as stated and no cash or other alternatives to the Prizes will be offered and the Prize is not transferable. The Prize Provider is not responsible for delivering the Prizes if they are not deliverable due to travel restrictions in the UK or in the destination of the Prize.

A Prize may not be claimed by a third party on a winner's behalf. Myprotein and the Prize Provider do not accept any responsibility if a winner is not able to take up a Prize.

Only 1 prize per entrant and per household. An entrant cannot win the Weekend in London, the Week in Turkey and the Week in Dubai Prizes. For the avoidance of doubt, an entrant who wins one of the Prizes, shall not be eligible to participate in the prize draw for the other remaining Prizes.

Except to the extent that Myprotein or the Prize Provider are prevented by law from doing so, Myprotein and the Prize Provider will publish the surname and town/county of residence of the Prize winners on Myprotein’s and the Prize Provider’s website and social media pages. If you object to your surname and/or county being published or made available, please contact Myprotein (social@myprotein.com) and the Prize Provider (collaborations@thomascook.com). In such circumstances, Myprotein and the Prize Provider may still provide this information to a relevant regulator on request.

Disqualification

To claim a Prize, an entrant must have complied with and remain in compliance with these Rules. If an entrant does not comply with all of the above requirements within the above time frames, or does not otherwise comply with these Rules, we may disqualify the entrant without any liability to that entrant.

We reserve the absolute right to disqualify without notice any entrants who we consider to have used improper technical means to enter the Promotion and/or we believe have engaged in fraudulent or abusive activities in connection with the Promotion.

Taxes

The Prizes may be taxable income under the laws applicable to the winners. To the extent permitted by applicable laws, any taxes applicable to the Prizes are the sole and exclusive responsibility of the winners. The winners are solely responsible for reporting the Prizes to the relevant tax authorities, and paying all taxes applicable to the Prizes, as required by the applicable tax laws. Upon request from Myprotein, a winner will promptly complete and submit to Myprotein all tax forms, certificates or authorizations as may be necessary under the applicable tax laws.

Limitation of Liability

Myprotein will not be liable for or accept any responsibility for: (i) any failure by the winner or any entrant to comply with these Rules; (ii) any disruption, delay or misdirection of entries; or (iii) any server, system or network failures, malfunctioning or inaccessibility. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Promotion, if it is possible.

Notwithstanding this section (Limitation of Liability), nothing in these Rules shall be construed to limit or exclude Myprotein’s liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other liability whose limitation is prohibited by law.

Data Protection

Myprotein collects and uses personal data to conduct the Promotion, as is necessary for Myprotein to be able to perform its agreement with you and in order to comply with its legal obligations, including to select the winners, deliver the prizes and publish the results (as required by advertising regulations).

Governing law and jurisdiction

The Promotion, these Rules and any dispute arising therefrom shall be governed by English law, and the parties submit to the exclusive jurisdiction of the courts of England and Wales.

The above choice of law and jurisdiction does not deprive entrants of the protection under mandatory statutory provisions that cannot be waived under the law which would have otherwise been applicable.

General

All of our decisions will be final and binding and no correspondence will be entered into.

If any provision of these Rules (or any part thereof) is held to be invalid or otherwise unenforceable or illegal, the invalidity or unenforceability of any provisions (or any part thereof) shall not affect the validity or enforceability of any other provision and all remaining provisions (or any part thereof) will remain in full force and effect and shall be construed in accordance with their terms as if the invalid or unenforceable or illegal provision were not contained herein.

The original version of these Rules is drafted in the English language. If these Rules are translated into any other language, the English language version shall prevail.
