Enter for a chance to win a 2025 Williams Racing Experience Bundle & One Year’s Supply of Protein - (“Giveaway”)

These rules (“Rules”) set out how you can enter for a chance to win a Prize worth approximately £5,020 by participating in our Giveaway prize draw. The Promoter is THG Nutrition Limited (company number 13400484, trading as Myprotein) whose registered office is at Icon 1, 7-9 Sunbank Lane, Ringway, Altrincham, United Kingdom, WA15 0AF and THG Nutrition Poland sp.z.o.o with registered office address at ul. Magazynowa 1, Magnice, Lower Silesia 55-040 Poland (“Myprotein” or “we”). The Prize is provided by Williams Grand Prix Engineering Limited (company number 07825416) whose registered office is at Grove, Wantage, Oxfordshire, OX12 0DQ (together with Williams IP Holdings LLC and Dorilton Capital Management LLC, the “Prize Provider”, and together with Myprotein, the “Contest Entities”).

By entering the Giveaway, you are deemed to have read and understood these Rules and shall be unconditionally bound by them. A copy of these Rules shall be available at (https://www.myprotein.com) for the duration of the Giveaway. These Rules should also be read in conjunction with the Myprotein terms and conditions, available at https://www.myprotein.com/customer-services/terms-and-conditions.list.

We reserve the right to amend these Rules from time to time without notice.

How to enter

To be entered into this giveaway, you will need to: 

(a) scan the QR code on the Myprotein billboards appearing at the races globally between the 5 April and 7 July 2024 or follow the link (https://www.myprotein.com/partnerships/myprotein-x-williamsracing.list) to the Giveaway landing page;

(b) enter your email address into the data capture box on the Giveaway landing page,

points (a) – (b) above altogether shall be a “Qualifying Entry”.

Opening and closing dates

The Giveaway will begin at 21:01GMT on 31 March 2024 (“Opening Date”) and will close at 20:59 GMT on 8 December 2024 (“Closing Date”). Any entries submitted after the Closing Date will not be counted. No responsibility will be taken by the Contest Entities for any entry that is misdirected, lost for technical or other reasons or received after the Closing Date.

Who can enter and entry restrictions

Entries are limited to one Qualifying Entry per person and one per household. For the avoidance of doubt individual entrants may not use multiple email addresses for the purposes of entry into the Giveaway. The Contest Entities reserve all rights to disqualify you if your conduct is contrary to the spirit or intention of the Giveaway.

You must be at least aged 18 years of age (or the age of majority in the jurisdiction where you reside if higher) at the time of entry. The Giveaway is only open to residents in the UK (excluding Northern Ireland), USA (excluding New York, Florida and Rhode Island), Germany, France, Italy, Japan and China (the “Territories”). The Contest Entities reserve the right to request proof of age and residency before awarding any Prize and to disqualify any entrant who is unable to provide such proof on request.

You are not permitted to enter the Giveaway if you are an employee, a direct family member of any employee, or agent of Myprotein, any THG company or the Prize Provider, , or if you are otherwise professionally connected with the Giveaway.

In entering the Giveaway, you confirm that you are eligible to do so and eligible to claim the Prize.

Prizes

One Qualifying Entry will receive the following prize:

(i) a 12-month supply of Myprotein Clear Whey, provided as 1 x 20 serving size tub per month and subject to stock availability (where the 20 serving size tub is unavailable, a 35 serving size tub will be provided as an alternative). Each tub is estimated to be received within 3 weeks from the beginning of each month, starting from the date the winner provides their personal details as required. No previous year’s limited edition Clear Whey tubs will be available.; and

(ii) A VIP three day Williams Racing race experience for two people with Williams Racing at a race, held in 2025, selected by you in consultation with the Prize Provider and Myprotein and subject to availability, worth approximately £4,720, including accommodation for 4 nights, return flights (from a country within the Territories), transfer to and from the airports to the hotel accommodation and transfers to and from the race track, £100 spending allowance per day per person for 4 days, a Williams merchandise bundle, travel to and from the race track and race weekend tickets (Friday, Saturday and Sunday)

together being the (“Prize”).

Prizes are subject to valid passport and visa (if applicable) of the winner and their guest. In addition the winner and their guests are responsible for holding adequate travel insurance. Any other travel expenses or costs incurred by the winner and their guest aside to those set out above and that are incidental to the fulfilment of the Prize are the responsibility of the winner and their guest (including, but not limited to any costs for travel visas and insurance).The Winner must be fit to travel and adhere to all local and airline restrictions and requirements.

The winner will have 7 days from the date they claim the Prize to notify the Prize Provider of the race they wish to attend (subject to availability). Any changes made to the race calendar by the race promoters are out of the Prize Provider’s control.

Any queries in relation to the Prize must be directed to the Prize Provider.

Each Prize is as stated and no cash or other alternatives to the Prizes will be offered. The Prizes are not transferable.

A Prize may not be claimed by a third party on a winner's behalf. If the Prize is unable to be delivered to the winner for reasons outside Myprotein’s or the Prize Provider’s control, the winner forfeits the Prize. The Contest Entities do not accept any responsibility if a winner is not able to take up a Prize.

Prize Selection

The winner will be selected at random by a draw performed by a computer process from all Qualifying Entries and will be notified via the email provided on the Closing Date (“Prize Notification”). The winner must respond by email to the Prize Notification to confirm that the winner accepts the Prize and must provide the details requested in the Prize Notification to the Promoter within 14 days of the Promoter sending the Prize Notification. Failure to respond in this way, within the 14 day timescale, will be deemed to be a forfeiture of the Prize by the winner and the Contest Entities reserve the right to select another winner (again selected randomly in a draw) from all remaining Qualifying Entries.

Except to the extent that the Contest Entities are prevented by law from doing so, the Contest Entities will publish the surname and town/county of residence of the Prize winners on the Contest Entities’ websites and social media pages. If you object to your surname and/or county being published or made available, please contact Myprotein (0161 813 1487) and the Prize Provider (01235 777 700) . In such circumstances, the Contest Entities may still provide this information to a relevant regulator on request.

Disqualification

To claim a Prize, an entrant must have complied with and remain in compliance with these Rules. If an entrant does not comply with all of the above requirements within the above time frames, or does not otherwise comply with these Rules,the Contest Entities may disqualify the entrant without any liability to that entrant.

The Contest Entities reserve the absolute right to disqualify without notice any entrants who we consider to have used improper technical means to enter the Giveaway and/or we believe have engaged in fraudulent or abusive activities in connection with the Giveaway.

Taxes

The Prizes may be taxable income under the laws applicable to the winner. To the extent permitted by applicable laws, any taxes applicable to the Prizes are the sole and exclusive responsibility of the winner. The winner are solely responsible for reporting the Prizes to the relevant tax authorities, and paying all taxes applicable to the Prizes, as required by the applicable tax laws. Upon request from Myprotein or the Prize Provider, a winner will promptly complete and submit to Myprotein and/or the Prize Provider all tax forms, certificates or authorizations as may be necessary under the applicable tax laws.

Limitation of Liability

The Contest Entities will not be liable for or accept any responsibility for: (i) any failure by the winner(s) or any entrant to comply with these Rules; (ii) any disruption, delay or misdirection of entries; or (iii) any server, system or network failures, malfunctioning or inaccessibility. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Giveaway, if it is possible (and in the Contest Entities’ discretion).

Myprotein and the Prize Provider reserve the right to cancel, amend, withdraw, terminate or temporarily suspend this Giveaway in the event of any unforeseen circumstances or technical reason outside its reasonable control, with no liability to any entrants or third parties but will use all reasonable endeavours to avoid consumer disappointment and in the event of an early cancellation or termination of this Giveaway, Myprotein will select a winner from all Qualifying Entries received prior to any such early cancellation or termination. Such circumstances include, but are not limited to: industrial action, civil unrest, fire, flood, storms, earthquakes, acts of terrorism, acts of war, governmental action or any other event that is beyond the control of Myprotein and the Prize Provider.

By participating,Participants agree, to the maximum extent permitted by law, to release the Contest Entities and each of their respective affiliates, divisions, retailers or distributors or advertising and promotion agencies and each of their respective owners, members, officers, directors, employees, agents or representatives (collectively, “Released Parties”)from and against any and all claims, demands, losses and liabilities of any nature whatsoever, which entrant may now or hereafter be entitled to assert, including but not limited to, any death, injury, loss of enjoyment, damage to computer equipment, or other harm or loss of any nature whatsoever caused or contributed to by participation in the Giveaway, and/or in connection with the awarding, receipt and use or misuse of the Prize, and/or claims based on publicity rights, defamation or invasion of privacy.Everything regarding this Giveaway, including the prizes, are provided “as is” without warranty of any kind, either express or implied.Winners acknowledge that the Contest Entities nor their agents have made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to any prize, including, but not limited to, its quality, mechanical condition or fitness for a particular purpose.

To the maximum extent permitted by law, you indemnify the Contest Entities and their affiliates, subsidiaries, parent companies, licensors, advertising and promotional agencies, and all of their officers, directors, shareholders, employees and agencies at all times from and against any and all liability, claims, demands, losses, damages, costs and expenses arising out of or relating to your participation in the Contest or receipt or use of any Prize.

By participating in the Contest, you agree that to the extent permitted by applicable law: 

(1) any and all claims, judgements and awards will be limited to actual third-party, out-of-pocket costs incurred, (if any), not to exceed twenty five pounds sterling (£25.00), but in no event will legal fees be awarded or recoverable; 

(2) under no circumstances will you be permitted to obtain any award for, and you hereby knowingly and expressly waive all rights to seek, punitive, incidental, consequential or special damages, lost profits and/or any other damages, other than actual out-of-pocket expenses not to exceed twenty five pounds sterling (£25.00), and/or any rights to have damages multiplied or otherwise increased; 

(3) your remedies are limited to a claim for money damages (if any) and you irrevocably waive any right to seek injunctive or equitable relief.

The Giveaway is in no way sponsored, endorsed, administered by or associated with Formula 1, any Formula 1 race or any social media platform. The Contest Entities make no representations or warranties of any kind, express or implied, regarding the Giveaway or your participation therein or the Prize and your acceptance or use of the Prize, including your admittance to or attendance of any Formula 1 race.

Notwithstanding this section (Limitation of Liability), nothing in these Rules shall be construed to limit or exclude the Contest Entities’ liability for death or personal injury caused by their negligence, for fraud or fraudulent misrepresentation, or for any other liability whose limitation is prohibited by law.

Data Protection

The Contest Entities collect and use personal data to conduct the Giveaway, as is necessary for the Contest Entities to be able to perform their agreement with you and in order to comply with their legal obligations, including to select the winner, deliver the prize and publish the results (as required by advertising regulations).

Governing law and jurisdiction

The Giveaway, these Rules and any dispute arising therefrom shall be governed by English law, and the parties submit to the exclusive jurisdiction of the courts of England and Wales.

The above choice of law and jurisdiction does not deprive entrants of the protection under mandatory statutory provisions that cannot be waived under the law which would have otherwise been applicable.

General

All of the Contest Entities’decisions will be final and binding and no correspondence will be entered into.

If any provision of these Rules (or any part thereof) is held to be invalid or otherwise unenforceable or illegal, the invalidity or unenforceability of any provisions (or any part thereof) shall not affect the validity or enforceability of any other provision and all remaining provisions (or any part thereof) will remain in full force and effect and shall be construed in accordance with their terms as if the invalid or unenforceable or illegal provision were not contained herein.

The original version of these Rules is drafted in the English language. If these Rules are translated into any other language, the English language version shall prevail.
